Definitions

These terms and conditions should be read carefully and apply to all bookings for parking or accommodation at Scilly Parking or Mount View Overnight Accommodation whether made directly or through a third party, or via the following websites;

In these terms “you” and “your” refer to any person who makes the booking.

In these terms “we”, “us” and “our” refers to Scilly Parking or Mount View Accommodation.

In these terms “arrival date” refers to the date, as per the booking confirmation, on which you are due to stay overnight with us or on which your parking is due to commence, or whichever falls earliest where parking and accommodation have been booked together.

Any contract made between you and us, which will be formed by the completion of a booking, is governed by English Law.

Please note: Our website, policies, and terms and conditions are subject to change at any time without notification.

General Terms

Booking Terms

When you make your booking you will be given a unique booking reference number via an email.

The booking confirmation which you receive is subject to satisfactory completion by you of the booking and receipt of a deposit or full payment by us.

Upon confirmation of your booking, you have entered a legally binding agreement to pay for the cost of your booking in full.

Your booking is non-transferable either from you to someone else, or between different car parks.

The booking confirmation is only valid for the dates shown and at the price shown for accommodation or car parking during the stated period, and is only valid with Scilly Parking or Mount View Accommodation.

Full payment for your booking must be received two months prior to your arrival date unless otherwise agreed by us. Non-payment of this balance by the due date may be taken as cancellation. This should not be seen as relieving you of the legal responsibility to pay the full amount. We reserve the right to offer your parking space to other customers if full payment is not received within this timescale.

We strongly recommend that you take out suitable cancellation insurance. Your insurance should cover all risks, including transport disruption, public transport cancellation, accident, breakdown, loss or damage to personal property.

Pricing & VAT

The tariff charge applied is that at the time of booking.

We reserve the right to amend prices quoted on the website and in advertising material due to errors or omissions.

If your actual entry and exit time changes from your specified booking and as a result your parking duration runs into another 24 hours over and above the period booked you will be liable for any additional days parking.

Please note that all Scilly Parking prices are inclusive of VAT.

Cancellations and amendments

Deposits are non-refundable.

If you cancel your booking after making full payment you will be charged the full value of your booking.

We will allow you to amend your booking without charge up until 60 days prior to your parking arrival date. Within 60 days of your arrival date it will not be possible to amend your booking.

If you wish to amend your booking please ring us on 01736 740277 to discuss this option. If you do not speak with us more than 60 days before your arrival date you will not be eligible to amend your booking.

We strongly advise you to take out your own travel insurance.

Prohibited activities

Misusing, obstructing or damaging any facilities or other vehicles in the car park, or accommodation, including but not limited to, dropping litter or fly-tipping waste on the car park;

Filming or taking photographs of any vehicles, the car park or other users of the car park;

Using the full facilities of a camper van, including, but not limited to, the toilet, bathroom and kitchen;

Doing or attempting to do anything which is a criminal offence or breach of the law;

Any anti-social or annoying behaviour which may cause offence or inconvenience to us or any other customer but not limited to; drinking alcohol in the car park, possession or use of illegal substances, fighting and/or loitering, having any animals off a lead when using our site or transfer service, excessive noise, intimidating or abusive language or behaviour;

Failure to follow our written or verbal instructions;

We reserve the right to terminate your booking if you, anyone staying with you, your passengers or anyone else under your authority or control do any of the things prohibited above. We reserve the right, in our absolute discretion, to add to the list of prohibited activities at any time. Any of our representatives may require you to leave at any time and they are authorised if necessary to call for police assistance to have you removed.

In the event we terminate a booking due to a serious breach of these Terms and Conditions no refund will be returnable.

Claims and complaints

If;

  • Your vehicle sustains damage while in the car park;
  • Your vehicle is stolen or any possessions are stolen from your vehicle while it is in the car park; or
  • Your possessions are lost, damaged or stolen while staying at our accommodation; or
  • You suffer an injury;
    You should:
    a) immediately inform either a member of staff at the car park or otherwise call us on 07855739060
    b) in the case of theft, immediately inform the police; and
    c) notify your insurers promptly.

Whilst every care is taken to ensure your complete satisfaction with our services, in the unhappy event of you having cause for complaint, the matter should be reported to us as soon as possible. Regrettably we are unable to entertain complaints made after you have returned home. Reports, appreciative comments or constructive suggestions for improvement will always be gladly received.

Force Majeure

Neither Scilly Parking nor Mount View Overnight Accommodation accept liability for any cancellation, curtailment or otherwise caused by national or global pandemic diseases, reason of war, or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural and nuclear disaster, fire, adverse weather conditions or technical problems due to transport, closure or congestion of airports, cancellation or changes of schedules of airlines, and all similar events beyond its control. Furthermore, Scilly Parking and Mount View Overnight Accommodation cannot accept responsibility where the performance or prompt performance of this contract with you is prevented or affected as a result of such circumstances beyond our or your control.

GDPR

As a commitment to the General Data Protection Regulation we will never share your information, in any form, with a third party unless legally requested to do so.

General

Each of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

Accommodation Terms

Occupation Of The Accommodation

The accommodation unless otherwise stated is available from 4.00pm and must be vacated by 9.30am on the day of departure. The accommodation is occupied only for a holiday, and the total number of persons must not exceed two adults.

We are unable to accommodate children.

Pets

We only allow a maximum of 2 x 'medium' sized dogs per property. They are not permitted on the furniture, nor should they be left unattended in the property. The dog owner is responsible for cleaning up dog’s mess and disposing of it in the waste bin provided. Bags can be provided if necessary.

Cleaning & Damage Charges

We reserve the right to charge any guests for extra cleaning, rectification/repair or replacement that may be necessary on departure. The word of the owner or their representative will be final in this respect.

Parking Terms

Our responsibilities

We must operate the car park and transfer services with reasonable skill and care (“our obligations”). If we do not, we are only responsible for direct loss or damage you suffer as a foreseeable result of our breach of our obligations or our negligence or the negligence of our employees.

We do not exclude or limit in any way our liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors.

Our car park is secure only insofar as we will take measures to restrict access to members of the public and monitor persons using our site.

We cannot guarantee that members of the general public or customers will not enter our car park and cause damage to property and/or engage in criminal activity. Accordingly, you park your vehicle in the car park at your own risk. We cannot and do not guarantee the security of your vehicle and/or its contents.  For the avoidance of doubt we do not accept liability for damage to your vehicle (whether caused accidentally or by vandalism) or theft of/from your vehicle in these circumstances.

We will not be liable to you for any special, indirect, or consequential loss, including but not limited to: any loss of profit, loss of enjoyment, loss of revenue, loss of data or loss of earnings.

Your responsibilities

You must ensure to provide us with your vehicle registration either at the time of booking or else on arrival.

Your vehicle must be roadworthy. We reserve the right to deny entry to vehicles which in our opinion may pose a risk to health and safety in any form.

You must comply with all directional signage and other instructions after entering the car park.

You must park fully within the limits of a marked bay and do not straddle bays or block the flow of traffic through the car park. If your vehicle straddles two parking bays, you will be liable to pay an additional tariff for a second space.

You must drive carefully and responsibly in the car park. You must also ensure that any children and animals are properly supervised and are at all times accompanied when using the car park. Please take care to be aware of all vehicles and pedestrians whilst using the car park. 

If the car park and/or the equipment in the car park is damaged by you, your vehicle, its contents or the passengers in the vehicle then, except where the damage arises as a direct result of our negligence, we will seek to recover the cost of that repair and associated administration costs from you.

When you have parked your vehicle it is your responsibility to ensure that you:

  • Lock your vehicle securely
  • Fully close all the windows of your vehicle
  • Apply your handbrake correctly
  • Engage any steering lock, alarm or immobiliser you have
  • Not leave any person or animal within your vehicle
  • Ensure that your possessions are placed in a locked boot and are not on display

Scilly Parking cannot be held responsible for any loss or damage whatsoever occurring to your vehicle or possessions within it resulting from your failure to do these things.

Transfer Terms

If you arrive at the car park with non-standard luggage or equipment, that has not been authorised for carriage by us, you will be responsible for arranging transfer of these items to their destination. We will not be responsible for missed travel connections arising from you making such arrangements nor providing booking refunds where such circumstances mean you are unable to use our services.

For the avoidance of doubt, we will transport two bags of standard holiday luggage weighing no more than 25kg and a medium sized piece of hand luggage per customer.

Within these terms camping equipment is classified as non-standard luggage.

Please remember you are responsible for loading and removing all your luggage/belongings from our transport at the quay/car park.

Our vehicles are fitted with seat belts, and these must be worn for the duration of the transfer journey. We cannot accept liability for injuries caused as a result of failure to wear the seat belts provided.

Should you wish to bring your own child seat on board the transfer vehicle you may fit the seat in the minibus yourself. We are able, if requested, to return the seat to our site and store it for you until your return. On return we will bring the child seat on the transfer vehicle to collect you but again you will need to fit the child seat yourself.

We offer the use of child booster seats but it is your responsibility to ensure the booster seat is suitable for the use of any child travelling on your booking and to fit the seat correctly within the transfer vehicle. We accept no responsibility for the fitting of child seats.

If the transfer vehicle/or the equipment in the transfer vehicle is damaged by you, your vehicle, its contents or the passengers in the vehicle then, except where the damage arises as a direct result of our negligence, we will seek to recover the cost of that repair and associated administration costs from you.

Late or Missed Arrivals

At the time of booking we will let you know the time you need to arrive with us, in order to use our transfer services. If your Skybus, Scillonian or Penzance Heliport departure times subsequently change, it is your responsibility to let us know in order that we can provide you with a revised arrival time.

If you arrive at the time specified and we fail to provide pre-booked transfer to Scillonian, Skybus or Penzance Heliport, our liability will be strictly limited to a full refund of the cost of your booking.

In the event of your late arrival or not being ready to depart at the specified time, where reasonably possible, we will provide you with transfer to Scillonian, Skybus or Penzance but can accept no responsibility for missed connections. Under these circumstances we are not liable to refund your booking (whether or not we are able to provide you with a transfer) and you will be liable to pay the following;

  • £10 for transfer to Penzance Heliport
  • £12.50 for transfer to Scillonian
  • £45 for transfer to Land's End
Abandoned vehicles

We are entitled to regard as abandoned any vehicle left in the car park for more than 28 days without prior notification and which is not known by us to be covered by a valid booking.

We reserve the rights to engage and/or permit a lawful authority to remove (or where we are unable to identify the current legal registered keeper of the vehicle, to take steps ourselves to remove) and to dispose of as waste or sell any abandoned vehicle.  Before proceeding with the disposal or sale of abandoned vehicles we will:

a) refer the matter to the appropriate authorities, which may include the local police and the DVLA; and

b) affix a notice to the vehicle at least 7 days before the date on which we propose to remove the vehicle stating that the vehicle will be removed and sold when that period expires.

Abandoned vehicles will be disposed of as waste or sold by auction.  Where sold by us, the proceeds of sale will be applied in and towards satisfaction of all sums owing to us together with the expenses of sale and our reasonable storage and removal costs for the period during which the vehicle is in our possession.

Any balance of the sale proceeds remaining after satisfaction of any sums owing will be held by us on behalf of the registered keeper of the vehicle and paid over on proof of entitlement.
